Privacy Policy

Intelcom Courrier Canada Inc. ("Intelcom" or "we") values your privacy.

This Privacy Policy applies to your personal information that will be collected and communicated to Intelcom by your employer or collected from Intelcom as well as through the mobile application Ride Along (the "Application").

Why do we collect your personal information?

We collect your basic personal information (name, contact details, driver’s licence,) directly from you or from your employer, as well as data relating to geolocation and past and future deliveries, which will be collected directly through the application. This information is collected for the following purposes:

  • Deployment and use of our Application to track delivery trajectories, monitor current deliveries and inform you of upcoming deliveries;
  • Contact you in connection with the above.

To whom do we communicate your personal information?

We may disclose your personal information outside Quebec. Our service providers offer services required for the operation of the Application, including :

  • Hosting and technological infrastructure related to the Application;
  • Financial and accounting audits;
  • IT support for the development and operation of our mobile application.

What rights do you have regarding your personal information?

At any time, you can :

  • Withdraw your consent to the use or disclosure of your personal information.
  • Request access to or rectification of your personal information

This privacy policy describes how we collect from your employer and through the Application), use, communicate and protect your personal information and how you can exercise your rights, for example to access or rectify your personal information.

What is the scope of this policy?

This Privacy Policy applies to the personal information of Independent Delivery Contractors (“IDC”) and their drivers that are collected as part of the implementation and operation of the Application.

What do these terms mean?

"applicable privacy laws" means any laws, regulations, recommendations or notices applicable to privacy matters, including the Act Respecting the Protection of Personal Information in the Private Sector (Quebec) and the Personal Information Protection and Electronic Documents Act (PIPEDA) and any other laws, regulations, recommendations or notices that replace, supplement, amend, extend, re-enact or codify applicable privacy laws.

"subcontractor" any person not employed by Intelcom who performs services governed by a service agreement.

"personal information" means any information that relates to an individual and allows, directly or indirectly, that individual to be identified, such as a name, an employee number, an online tracking identifier such as an IP address or one or more particular characteristics relating to the physical, physiological, mental, economic, cultural or social identity of that individual.

Why do we collect your personal information?

We will only collect, use and disclose personal information that is necessary to conduct our business and that which is necessary to fulfill the service agreement between Intelcom and your employer.

This includes the following uses:

  • Deployment and use of our mobile application to track delivery trajectories, monitor current deliveries and inform you of upcoming deliveries;
  • Contact you in connection with the above;
  • Obtain your feedback on product enhancements.

How do we obtain your consent?

We collect, use and disclose your personal information with your consent, directly from your employer, or as permitted or required by law. How we obtain your consent (i.e., the manner in which we obtain it) depends, among other things, on the circumstances. For example, in certain geolocation-related situations, Intelcom may obtain your consent directly from you to activate the geolocation feature on your mobile device.

What personal information do we collect?

We may collect the following categories of personal information from your employer. We may also collect certain information directly from you, such as geolocation information.

Identity information

  • Name
  • Postal and e-mail addresses
  • Phone number
  • Application login and password

Application logistics features

  • Geolocation of devices used for work as part of the Application used for deliveries;
  • Data on planned and actual deliveries , including :
  • Date and time of deliveries;
  • Proof of delivery that you submit via the application (photos, signatures);
  • In the event of delivery failure, reasons for the failure and any additional comments you may have in this regard.

To whom do we communicate your personal information?

We may disclose your personal information to third parties or service providers for the purposes set out below. We will endeavour to protect personal information disclosed to third parties by entering into contractual agreements and, where applicable, written undertakings with them, requiring them to adopt appropriate confidentiality and security practices, procedures and measures.

Service providers

We may use service providers to perform services on our behalf. We provide these service providers with only the personal information required to perform the services entrusted to them.

The categories of service providers with access to your personal information include service providers hired to :

  • Hosting and technological infrastructure related to the Application;
  • Financial and Accounting audits;
  • IT support for the development and operation of our Application;

To extend permitted or required by law

We may disclose personal information when required by law, regulation, court order, subpoena, valid demand or search warrant, or in response to a government investigation or other lawful request.

We may also disclose such information to our accountants, auditors, agents and attorneys to enforce or protect our rights. In addition, we may disclose certain personal information when we reasonably believe it is necessary to do so to protect our rights, safety or property, or others, to the extent provided or permitted by law.

Commercial transaction

We may disclose personal information to a third party in connection with a reorganization, merger, sale, joint venture, assignment or other disposition of all or part of our business, brands or other assets.

That said, if such a transaction is completed, personal information will continue to be protected by applicable Privacy Laws. If such a transaction is not completed, we will require the other party to refrain from using or disclosing your personal information in any way and to destroy it completely.

What do we expect from you?

We will ensure that the personal information we collect, use or disclose about you from your employer is as accurate, up-to-date and complete as possible.

To the extent that you provide us with personal information, we assume that this information is accurate and up-to-date. If any of your personal information changes during the course of your service as an IDC or its driver, we also expect you to inform your employer so that we can update it.

How long do we keep your personal information?

We will retain your personal information in accordance with our business and legal obligations and only for as long as is necessary for the fulfillment of the purposes identified in this Privacy Policy, unless longer retention is required by law.

If we use personal information to make a decision that directly affects you, we will retain the information for a reasonable period of time after using it and for at least one year after making the decision.

Where do we store your personal information?

We currently store the personal information of subcontractors (IDC) in Canada. If necessary, information may also be held and used by our service providers located elsewhere in the world. As a result, we may disclose personal information in countries other than your country/province/state of residence, where privacy laws may differ.

If your personal information is used outside your country/province of residence, it is subject to the laws of the country/province/state in which it is located and may be disclosed to the governments, courts, law enforcement or regulatory agencies of that other country, or disclosed in accordance with the laws of that country. However, our practices regarding your personal information will always be governed by this Privacy Policy and applicable privacy laws.

What rights do you have over your personal information?

We may ask you to provide proof of identity before responding to your request. This identifying information will only be used for this purpose.

You have a number of rights with respect to your personal information, including :

Right of access and rectification

You may request access to and copies of the personal information we hold about you.

If your personal information is inaccurate, incomplete or ambiguous, or if its collection, communication or storage is not authorized by law, you may request that it be corrected.

You may also ask us for information about the source of your personal information (if it was not obtained from you), as well as the names of the people who have access to your information and details of how long they keep it.

Right to withdraw consent

You may withdraw your consent to the use or disclosure of your personal information.

However, please note that withdrawing your consent may jeopardize your continued subcontractor relationship with Intelcom.

How do we protect your personal information?

We implement reasonable procedures and security measures to ensure the protection of your personal information, whether it is stored on our servers or with one of our service providers.

Only authorized and qualified personnel who need to consult your personal information in the performance of their duties have access to it.

However, no security measure is absolute or fully guaranteed. If you have reason to believe that your interaction with us is no longer secure (for example, if you believe that the security of any information you have provided to us has been compromised), please contact us immediately at the address listed in the "How can you reach us" section.

Who will assess compliance with this Privacy Policy?

Our Privacy Officer will independently assess allegations of violations of this Privacy Policy by reviewing practices and procedures and determine whether follow-up corrective action is necessary, including disciplinary action up to and including termination.

Are we going to update this Privacy Policy?

This Privacy Policy is current as of the update date at the bottom of the page.

If we make material changes to this Privacy Policy, for example, to comply with new legal requirements or due to technological developments of the application, we will notify you. We will make the new version available to you via the application, indicating the date of the last update.
